Terms of Service

Effective September 8, 2026 · Construction Guy CRM (constructionguycrm.com)

These terms govern your use of Construction Guy CRM (the "Service"), operated by Whithouz LLC ("we", "us") from Lutz, Florida, USA. By creating an account or using the Service you agree to them on behalf of yourself and the company you register.

1. The Service and editions

Construction Guy CRM is a web and mobile application for managing contacts, quotes, contracts, jobs, crews, bids and billing. It is offered in two editions:

Field edition — for home-services contractors. Free to use. If you choose to accept card payments from your customers through the Service, those payments are processed through Stripe Connect and Whithouz collects a platform fee of 1% of each card payment (in addition to Stripe's own processing fee, which you pay as the merchant), shown to you when you connect your Stripe account and before you send your first payment link.
Builder edition — for general contractors and developers. A paid subscription, billed monthly or annually.

2. Accounts

You must provide accurate information and keep your password secure. You are responsible for everyone you invite to your company workspace and for everything done under your accounts. You must be at least 18 and able to enter a binding agreement for your business.

3. Subscriptions, billing and cancellation (Builder edition)

Subscriptions are billed in advance through Stripe and renew automatically at the end of each billing period until canceled. Prices are shown at checkout and may change with at least 30 days' notice before your next renewal.
New Builder-edition companies get a short free period to set up before a subscription is required; after it, the workspace becomes read-only until a subscription is active. Your data is not deleted.
You can cancel at any time from Company Profile → Billing → Manage billing. Cancellation takes effect at the end of the current period; we do not issue partial-period refunds except where required by law.
If a renewal payment fails we will retry and notify you. If it remains unpaid after the grace period shown in the app, the workspace becomes read-only until payment is resolved.
Subscriptions are sold on our website. Where the Service is offered as a mobile app, the app is a free companion to a web-purchased subscription.

4. Payments from your customers (Field edition)

Card payments are processed by Stripe under the Stripe Connected Account Agreement, which you accept when you connect your account. You, not Whithouz, are the merchant of record for those payments.
Refunds, chargebacks and disputes on your customers' payments are your responsibility and are debited from your Stripe balance. Whithouz's platform fee is deducted automatically from each successful payment.
You must only use the Service to collect payment for real goods and services you provide, and you must comply with Stripe's prohibited-business rules.

5. Your data

You own the data you and your team enter, including your customers' information. You grant us the limited rights needed to host, process, back up and display it in order to provide the Service. Our Privacy Policy describes how we handle it. You are responsible for having the right to enter your customers' information and for the accuracy and legality of the documents you generate and send.

6. Electronic signatures and documents

The Service lets your customers sign contracts and completion forms electronically and records the signer's name, signature image, IP address and time. You are responsible for deciding whether an electronic signature is appropriate for a given agreement and for the content of your own contract terms, which we do not review.

7. Acceptable use

You agree not to: use the Service for unlawful purposes; send spam or unsolicited messages through it; upload malicious code; attempt to access other companies' data; reverse-engineer or resell the Service; or overload the platform. We may suspend accounts that violate these rules.

8. Availability and support

We aim to keep the Service available at all times but do not guarantee uninterrupted operation. We may modify or discontinue features with reasonable notice. Support is provided by email at the address below.

9. Termination

You may close your account or delete your company workspace at any time from within the app or by contacting us. We may terminate accounts that breach these terms. On termination we delete your data per the Privacy Policy, retaining only what the law requires; you may export your data before closing.

10. Disclaimers and limitation of liability

The Service is provided "as is" without warranties of any kind. Whithouz is not a party to any contract between you and your customers and does not guarantee payment by them. To the fullest extent permitted by law, Whithouz's total liability for any claim arising from the Service is limited to the amount you paid us in the twelve months before the claim, and we are not liable for indirect, incidental or consequential damages, including lost profits or data.

11. Governing law

These terms are governed by the laws of the State of Florida, USA. Disputes will be resolved in the state or federal courts located in Hillsborough County, Florida, and you consent to their jurisdiction.

12. Changes

We may update these terms. Material changes will be announced in the app or by email at least 14 days before they take effect; continued use after that date is acceptance of the new terms.
